Senior Litigation Solicitor
Venesky-Brown’s client, a public sector organisation in Glasgow, is currently looking to recruit a Senior Litigation Solicitor for a 2 year contract on a salary of £57,992/Annum (PAYE). This role can be worked from different locations across Scotland and hybrid. 
 
Responsibilities  
 
– To ensure the effective delivery of legal services by developing and executing a policy and procedure for the provision of strategic legal advice on complex, high value or high-profile Employment issues, and the execution of all associated types of legal work (Including Tribunal Work).  
– To undertake legal drafting of complex litigation and legal research and analysis which is tailored to take account of policy and the organisational context, liaising with a range of stakeholders to ascertain the needs.  
– To be responsible for the provision of all legal advice to support the requirements in relation to Employment Law and General Litigation.  
– To keep up to date with the law, in particular in the specialist field of Employment, fire Safety Enforcement and General Litigation and disseminate information to members/employees of the Service (including designing and delivering training) and to contribute towards the development of new or revised policies and procedures which comply with new laws.  
– To work and support our Human Resources Team, in a Business Support Partnership approach, including support with reviewing and developing appropriate policies and procedures.  
– To undertake and lead in the support of allocated casework, delegating as appropriate. Ensuring appropriate representation is provided and all relevant litigation deadlines are met by the team.

– To support the Legal Team by mentoring and supervising all Solicitors, Paralegals, Trainee Solicitors and any Legal Placements/ Assistants, as required, and to assist with the implementation of any necessary HR policies.  
– To contribute towards major project plans, ensuring that appropriate legal scrutiny is incorporated into project timescales and litigation risk is fully considered.  
– To ensure future litigation is minimised and mitigated to ensure there is an evidence based decision making approach in line with Policies, Procedures and statutory framework.  
– To represent at court for all litigation actions. In additional, to instruct external lawyers where appropriate within specialised fields and to manage the day-to-day relationship with external lawyers on individual projects, managing and agreeing the fee paid for the advice, scrutinising invoices and providing feedback on the quality of the advice to ensure that the appropriate standard of legal advice to the Service is maintained.  
– To work with the Legal Services Manager to develop a set of service standards for the review of litigation processes by the Legal Services Team, including, aims and objectives, outcomes, target response and turnaround times.  
– To undertake and/or provide assistance to insurance panel solicitors for them to undertake representation and conduct cases in the Courts and before Quasi-judicial bodies, mainly but not exclusively defending.  
– To investigate and/or provide assistance to claims handlers for them to investigate claims (e.g. Employers’ Liability and Public Liability).  
– To provide employment law advice particularly in relation to disciplinary cases and managing absence cases and to represent the Service at Employment Tribunals and Employment Appeal Tribunals.  
– To liaise with other Directorates of the Service as required, with responsibility for providing day-to-day professional support to all Client Departments, managing and prioritising requests for assistance and input. 
– To support and advise on fire safety enforcement work, fire investigations and other related investigatory work.  
– To liaise with local authorities, partner agencies and external organisations (e.g. Insurers’ Claims Handlers) as appropriate.  
– To be aware of, promote, comply with and carry out responsibilities appropriate to the role in terms of the Service’s policies and procedures, in particular the Health & Safety Policy, the Equality Policy, the Code of Conduct, the Scheme of Delegations, the Standing Orders relating to Contracts and the Financial Regulations.  
– To develop, mentor and supervise the performance of employees within area of responsibility and to support recruitment of staff, as required.   
– To undertake any other duties consistent with the role as required by the Legal Services Manager or the Legal Services Manager’s line management, including the Head of Corporate Governance, Director of Strategic Planning, Performance and Communications and the Chief Officer.  
– To undertake all duties observing and preserving the confidential nature of the Service’s business both at the time of dealing with the matter and thereafter.  
– Travel to other offices and Courts within Scotland.  
 
Essential Skills: 
 
– Degree (LLB) in Scots Law or equivalent e.g. intra UK Transfer Test and Examinations  
– Diploma in legal Practice or equivalent depending upon year of qualification (e.g. PEAT 1 and PEAT 2)  
– Current Practicing Certificate (unrestricted) issued by the Law Society of Scotland  
– Minimum of 3 years Post Qualifying Experience, exceptions will be considered subject to proven track record in Employment Law.  
– Substantial Experience of: –  
– Employment Law  
– General Litigation and advocacy experience  
– Undertaking Legal Research and Statutory Interpretation  
– Providing Legal Advice on the application of Employment Law and General Litigation.  
– Litigation drafting.  
– Knowledge and experience of Data Protection, Equalities and Human Rights Legislation.  
– Experience of managing and/or supervising staff  
– Knowledge of and experience IT packages (ie Word, Excel and PowerPoint)  
– Experience of advising senior management on high profile and sensitive legal issues.  
– Driving Licence 
 
Desirable Skills: 
 
– 5 years Post Qualifying Experience  
– Recent legal training e.g. classes or CPD in the following subjects: 
– Employment Discrimination  
– Data Protection and Freedom of Information  
– Equalities and Human Rights  
– Health and Safety  
– Fire Enforcement  
– Experience of Enforcement, Fatal Accident Inquiries, Debt Recovery, Health and Safety.  
– Mediation qualification  
– Processing and advising upon insurance claims including liaising with insurance panel solicitors  
– Drafting of criminal charges and reporting to the COPFS  
– Preparing and delivering training/preparing articles for publication on legal topics  
– Mediating in commercial or employment matters  
– Advocacy Skills (including experience of representation at Employment Tribunals)
